Former Attica guard gets jail term, must pay $40,000 restitution

 A one-time Attica Correctional Facility officer formerly from Batavia was sentenced to four months in jail and five years of probation Monday in Genesee County Court.

James S. Gibbs, 33, now living in Monroe County, also was ordered to pay $40,000 in restitution for defrauding Workman's Compensation.

Gibbs claimed to be disabled while working as an officer at the prison but was working on the side plowing driveways and sealing parking lots. He was indicted in January and charged with 24 counts. He later pleaded guilty to grand larceny and fraud.

He was sentenced by Judge Robert C. Noonan.
