BATAVIA — A Genesee County grand jury has indicted a Maple Street man on charges that he repeatedly sexually assaulted a child.
Nelson E. Figueroa Jr., 31, is charged with two counts of predatory sexual assault against a child, first-degree sexual abuse and endangering the welfare of a child.
The first two counts accuse Figueroa of sodomizing a child less than 13 years old on May 1 and committed at least two criminal sexual acts against the child on repeated occasions between January 2018 and April 30 of this year.
Figueroa was first arrested after police went to his residence in May for an “unknown problem.”
While investigating, it was discovered Figueroa had sexually assaulted a child, police said at the time.
The predatory sexual assault charges are the most severe sex-related charged under New York penal law. They carry a maximum sentence of 25 years to life in prison upon conviction, the same as murder.
Figueroa remains in Genesee County Jail pending arraignment in Genesee County Court.
