State inmate contacted victim

ARCADE — While David M. Smith was languishing in Wyoming County Jail awaiting transfer to state prison for repeated violations of an order of protection last year, he contacted the victim 107 times.

The result was another three years added on to his prison sentence.

He has been in Greene Correctional Facility since July 2020.

Last week, state police arrested Smith, 35, and charged him with nine counts of felony aggravated family offense for contacting the victim from prison.

If convicted, Smith will likely see more time added to his prison term

Smith, of Arcade, had repeatedly violated orders of protection in 2019 and 2020. He was sentenced in March 2020 to 1 1/3 to four years in prison for aggravated family offense.

He was indicted in July of 107 counts of aggravated family offense, just before he was transferred to state prison.

He later pleaded guilty to five counts of aggravated family offense.

Smith remains in state prison pending an appearance in Wyoming County Court.
